1. Agreement to these terms

These Terms and Conditions govern your access to and use of the website at autopolicydesk.com, and any advisory or consulting service we provide. By using this website, sending us an enquiry or engaging our services, you confirm that you have read and accepted these terms. If you do not accept them, please do not use the website or our services.

2. Who we are, and what our services cover

Auto Policy Desk is a trade name of Amal Jahan Inc, an authorized independent insurance retailer working from 323 Morrow Field Ave, Elmira, NY 14904. Our services consist of quoting, comparing, explaining and arranging insurance coverage, and advising you on it. In practice that means personal auto, home and property, commercial auto and small fleets, specialty vehicles, and periodic policy reviews.

We are an independent insurance retailer. We are not an insurance company. In particular:

• Auto Policy Desk is a trade name of Amal Jahan Inc, an authorized independent insurance retailer;
• we work with selected partner carriers and licensed agencies and may receive commission from them;
• we are not an insurance carrier and do not set premiums, eligibility or claim outcomes; and
• we are not a government office, a motor vehicle department, a law firm or a tax practice.

Our quotes and advice are based on the information you give us and on what our partner carriers can offer. They do not replace your policy documents, which govern your coverage in every case.

3. No insurance contract is created

A quote we pass on is an indication of price and terms from a carrier, not a binder and not a policy. Coverage exists only once a licensed insurance carrier issues a policy, and only on that policy's terms, which means it is subject to the carrier's underwriting approval, payment of premium and any conditions it applies. Premiums, eligibility, exclusions and claim determinations all belong to the issuing carrier. If anything we provide conflicts with the terms of the policy issued to you, the policy governs.

4. Acceptable use of this website

You agree that you will not:

• use this website for any unlawful, fraudulent or misleading purpose;
• send information that is false, or that belongs to someone else without their authority;
• try to gain unauthorised access to any part of the website, its servers or its data;
• introduce viruses, malware or any other harmful code;
• copy, scrape or republish substantial parts of the website without our written permission; or
• use automated tools to submit forms or generate enquiries.

You must be at least 18 years old to send us an enquiry or engage our services.

5. Your submissions and communications

When you send us information through this website or contact us, you confirm that it is accurate and complete to the best of your knowledge, and that you are entitled to share it. Inaccurate information can lead to a comparison that does not reflect your real position, and we cannot take responsibility for advice that was based on information that was wrong or incomplete.

By giving us your telephone number and email address, you agree that we may contact you about your enquiry by those means. You can withdraw that consent at any time by telling us, or by emailing info@autopolicydesk.com. We do not make automated marketing calls and we do not send marketing text messages.

Please do not send Social Security numbers, driver licence numbers, bank details or similar sensitive identifiers through the website form or by ordinary email.

6. Fees and engagement terms

Our quotes and consultations are free. If you buy a policy through us, we may receive a commission from the issuing carrier or partner agency. This does not increase your premium. Any separate fee for specialised work will be agreed with you in writing before work begins. A specific engagement may carry additional terms, which we will set out in that written scope.

7. Intellectual property

Everything on this website, including text, design, graphics, logos, layouts, comparison formats and the written materials we produce for you, belongs to Auto Policy Desk or its licensors and is protected by intellectual property law. You may view, download and print material for your own personal, non commercial use, and you may of course use the advice and summaries we prepare for your own decisions. You may not republish, resell or distribute our materials commercially without our written consent.

8. Third party information and links

This website may contain information about, or links to, other organisations, including insurance carriers, licensed agencies, regulatory resources and mapping services. That information is there for general reference. We do not control third party content and we do not endorse any particular carrier, product or service unless we say so expressly in writing. Carrier names and marks belong to their owners and are used, where they appear, for identification and comparison only.

9. Disclaimers and limitation of liability

This website and our advisory services are provided as they are. We take reasonable care in preparing comparisons and advice, but we cannot warrant that the content is free of errors, complete or current at all times, because insurance products, rates, rules and availability change frequently and vary by state.

To the fullest extent permitted by law, Auto Policy Desk and its owners, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, savings, data or goodwill, arising out of or connected with your use of this website or your reliance on our advisory services. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to our services will not exceed the total fees you actually paid us for the service that gave rise to the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify and hold harmless Auto Policy Desk and its owners, employees and contractors against any claim, loss, liability, cost or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of this website, or your submission of information you were not entitled to share.

11. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict of law rules. You agree that the state and federal courts located in New York have exclusive jurisdiction over any dispute arising out of or relating to these terms or our services, and you consent to venue in those courts. Before starting formal proceedings, we ask that you contact us so we can try to sort the matter out directly.

12. Ending our relationship

We may suspend or discontinue access to this website, or decline to provide services, at any time and without notice where we think it is appropriate, for example in cases of misuse, abusive conduct, or a legal or regulatory requirement. Terms that by their nature should survive termination, including intellectual property, disclaimers, liability, indemnity and governing law, continue to apply afterwards.

13. Changes to these terms

We may revise these terms from time to time. The last updated date at the top of this page shows the current version, and continued use of the website after changes are posted means you accept the revised terms.

14. General provisions

• Entire agreement. These terms, together with our Privacy Policy, our Disclaimer and any written engagement scope, form the whole agreement between us about this website and our services.
• Severability. If any provision is found to be unenforceable, the rest continue in full force.
• No waiver. If we do not enforce a provision, that is not a waiver of it.
• Assignment. You may not assign your rights under these terms without our written consent. We may assign ours in connection with a business transfer.
